Christie Prepared to Take Gambling Issue to Supreme Court reports Bang The Book

(EMAILWIRE.COM, March 22, 2013 ) San Francisco, CA -- Officials in New Jersey have appealed the federal judge's decision to block legal sports betting within the state. The move was expected in the obviously high-stakes case that could end up finding its way to the Supreme Court before too long.

Governor Chris Christie, as well as leaders from both state legislative and owners of the Monmouth Park racetrack have filed notices of an appeal in the U.S. District Court in Trenton. The case will now be considered by the 3rd U.S. Circuit Court of Appeals in Philadelphia, while Christie has stated that he will make an appeal to the U.S. Supreme Court if it becomes necessary.

"We expect to move forward and believe firmly in our position," Michael Drewniak, a spokesman for the governor, said Wednesday.

The appeal is the result of the reaction by Christie to the U.S. District Court Judge Michael Shipp ruling that the federal ban on sports gambling is constitutional and superseded state law. The setback is slowing New Jersey's effort to revitalize the casinos and horse tracks in the state.

Shipp had sided with the National Collegiate Athletic Association and the country's four largest sporting leagues when here rejected the state's contention. By doing so he turned against the precedent of the Professional and Amateur Sports Protection Act of 1992 which unfairly allowed sports betting with four states.

The judge stated that individuals or institutions opposed to the act should take it up with Congress.

"Although some of the questions raised in this case are novel, judicial intervention is generally unwarranted no matter how unwise a court considers a policy decision of the legislative branch," Shipp wrote in his 45-page opinion that was issued February 28.

Following the voters approval of referendum that allowed gambling, Christie signed a law to legalize it within Atlantic City's 12 casinos and four major racing tracks. Anticipating a challenge, he had preemptively stated: "If someone wants to stop us, then let them try to stop us."
